Please read these Terms of Service ("Terms", "Agreement") carefully before using the Zamily mobile application and website (the "Service", "App"). By downloading, installing, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these terms, you may not use our Service.
1. Definitions
- "Zamily" ("we", "us", "our") refers to Xelora PTY LTD (ABN: 96 692 975 107), an Australian company that operates the Service.
- "User" ("you", "your") refers to any individual who accesses or uses the Service.
- "Family" (the group you manage in the app under Settings → Family) refers to users who have explicitly agreed to share location data with each other.
- "Content" refers to all data, text, images, and other materials shared through the Service.
- "Premium" refers to the paid subscription tier of the Service.
- "Free Tier" refers to the no-cost version of the Service with limited features.
2. Acceptance of Terms
By accessing or using Zamily, you:
- Acknowledge that you have read, understood, and agree to be bound by these Terms
- Confirm that you are at least 18 years old or have parental/guardian consent
- Agree to comply with all applicable laws and regulations
- Accept our Privacy Policy, which is incorporated by reference into these Terms
If you are using Zamily on behalf of a minor, you represent that you are the parent or legal guardian of that minor and consent to these Terms on their behalf.
3. Description of Service
Zamily is a family safety and location-sharing application designed to help families stay connected and safe. The main app navigation includes the Location, Driving, Safety, and Settings areas (labels as shown in the app). Our Service includes:
- Live Location Sharing: Real-time GPS location sharing between family members
- Automatic Trip Tracking: Detection and logging of trips with duration and related data—some views (such as full route playback or analytics) may be limited by plan as indicated in the app
- Place alerts: Notifications when family members enter or leave saved Places (geofences), subject to your plan’s Place limits and notification settings
- Emergency SOS: High-priority alerts from the Safety tab to your family
- Battery Monitoring: Sharing device battery levels with family members
- Trip history: Driving trips and related history—retention depends on your plan (see Free vs Premium limits in the app)
- Driving-related features: Driving detection and trip lists; additional alerts and analytics may be Premium as shown in the app
3.1 Platform Availability
Currently, Zamily is available exclusively on Android devices. An iOS version is in development and will be available in the future.
4. Eligibility and Account Registration
4.1 Age Requirements
- You must be at least 18 years old to create a Zamily account
- Users aged 13-17 may use Zamily under the direct supervision of a parent or legal guardian who has agreed to these Terms
- Children under 13 may not use Zamily except through an account created and managed by a parent or guardian
4.2 Account Creation
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your information to keep it accurate
- Choose a strong, unique password and keep it confidential
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
4.3 Account Security
You are responsible for:
- Safeguarding your account credentials
- Logging out of your account when using shared devices
- Monitoring your account for unauthorized activity
- Immediately reporting suspicious activity to Email Support
5. Acceptable Use Policy
You agree to use Zamily only for lawful purposes and in accordance with these Terms.
5.1 Required: Consent and Respect for Privacy
Tracking someone without their knowledge or consent is illegal and a violation of these Terms. You must:
- Only track individuals who have explicitly consented to be tracked
- Obtain consent from adult family members before adding them to your family in the app
- Ensure children understand (in age-appropriate terms) that their location is being shared
- Remove any family member immediately upon their request
5.2 Prohibited Activities
You may NOT use Zamily to:
- Track anyone without their explicit, informed consent
- Stalk, harass, intimidate, or threaten any person
- Monitor employees, domestic workers, or anyone outside your family without consent
- Engage in any illegal activity or facilitate crimes
- Violate any applicable local, state, national, or international law
- Reverse engineer, decompile, disassemble, or attempt to derive source code
- Interfere with or disrupt the Service, servers, or networks
- Use automated systems, bots, spiders, or scrapers
- Upload viruses, malware, or other malicious code
- Impersonate any person or misrepresent your identity
- Share your account credentials with unauthorized users
- Sell, resell, or commercially exploit the Service without authorization
5.3 Consequences of Violations
Violations of this Acceptable Use Policy may result in:
- Immediate suspension or termination of your account
- Permanent ban from the Service
- Reporting to law enforcement authorities (for illegal activities)
- Legal action to recover damages
6. Location Data and Privacy
By using Zamily, you expressly consent to:
- The collection of your device's GPS and location data
- The sharing of your real-time location with members of your designated family in the app
- The storage of location history according to your subscription plan
- The use of background location services (when enabled)
6.1 Your Control Over Location Data
You can:
- Revoke or change location permissions in your device system settings (this affects how the app can update your position)
- Manage family membership and roles from Settings → Family (subject to your permissions)
- Use Premium features such as Quiet Hours to limit notification noise (where available)
Note: The app does not provide a separate “pause sharing” switch—stopping sharing is achieved by adjusting OS permissions or leaving the family. Revoking location permission will prevent the app from working as designed.
6.2 Data Privacy Commitment
WE NEVER SELL YOUR DATA. As detailed in our Privacy Policy, we do not sell, rent, trade, or share your personal information with third parties for any purpose. Your location data is only visible to members of your family in the app.
7. Subscriptions, Payments, and Billing
Important: Zamily does not operate a web store and does not accept payment on zamily.app (no credit cards, PayPal, or other payment methods on this website). When paid subscriptions are offered, they are purchased and renewed only through the official app stores: Google Play for Android and, when the iOS app is available, the Apple App Store—using each platform’s standard in-app purchase and subscription systems (the same model as most consumer apps).
7.1 Current: Founding Families Program (Launch Period)
During our initial launch phase:
- The first 2,000 families to join receive complimentary Premium access
- Premium features include: unlimited Places (saved zones), extended trip history, driving-related alerts, Quiet Hours, priority support, and other Premium-only options described in the app
- No payment information is required during this period
7.2 Grace Period for Founding Families
When we transition to paid subscriptions:
- Founding Families will receive 60 days of free Premium before any charges apply
- You will be notified before the grace period ends
- You may choose to continue with Premium at the price shown in Google Play (currently about $4.99 USD/month per family) or switch to the Free Tier
- No automatic charges without explicit consent
7.3 Free Tier (Always Available)
After the Founding Families program ends, a free tier will be available with:
- Live location sharing
- Places (saved zones), up to 4 per family, with Place enter/leave notifications according to your settings
- SOS alerts
- Trip list and recent trip history (currently 7-day retention as implemented in the service)
- Standard email support
7.4 Premium Tier (price per Google Play; about $4.99 USD/month per family)
Premium subscribers receive:
- All Free Tier features, plus (where enabled in your app version):
- Unlimited Places (saved zones)
- Extended trip history (currently up to 90 days as implemented in the service) and features such as route playback on trips where the app provides them
- Trip analytics, summaries, and related insights (as shown on the Driving tab for Premium)
- Speed alerts, curfews, and other driving or child-safety options described in the app
- Quiet Hours and other Premium-only notification settings
- Priority support (see our Support Center—no guaranteed response time)
7.5 Billing and Payment
- We do not collect payment details on zamily.app; checkout always happens in the Play Store or App Store app on your device when you subscribe inside Zamily
- On Android, when in-app purchases are available, payments are processed by Google Play; the exact purchase flow and price appear in Google’s checkout
- On iOS (when the app is released), subscriptions will be processed by Apple via the App Store under Apple’s standard in-app purchase terms
- Subscriptions typically renew monthly unless cancelled, as shown in your Google Play or Apple ID subscription settings (depending on platform)
- You may cancel through your Google Play or App Store / Apple ID subscription settings; follow Google’s or Apple’s instructions for your device
- Cancellation generally takes effect at the end of the current billing period—see the applicable store’s terms
- Refund rules follow Google Play or Apple policies; we do not control the stores’ refund decisions
7.6 Price Changes
We will notify you at least 30 days before any price changes. Your continued use after a price change constitutes acceptance of the new price.
8. Intellectual Property Rights
8.1 Our Intellectual Property
Zamily, the Zamily logo, and all related trademarks, service marks, graphics, and logos are the exclusive property of Xelora PTY LTD, an Australian company. The Service and its original content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws under Australian and international law.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the app on devices you own or control
- Use the Service for personal, non-commercial purposes
- Access the Service through standard, unmodified web browsers and mobile apps
8.3 Prohibited Uses
You may not:
- Copy, modify, or create derivative works of the app or Service
- Distribute, sell, lease, or sublicense the app or Service
- Remove or alter any copyright, trademark, or proprietary notices
- Use our trademarks without prior written consent
- Frame or mirror any part of the Service without authorization
8.4 User-Generated Content
You retain ownership of any content you submit to the Service (profile photos, names, etc.). By submitting content, you grant us a limited license to use it solely for the purpose of providing the Service.
9. Termination
9.1 Termination by You
You may terminate your account at any time:
- Through the app: Settings → scroll to Delete Account (not available for child accounts managed by a parent)
- By emailing Email Support
Upon termination, your data will be deleted in accordance with our Privacy Policy.
9.2 Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms
- Use the Service for illegal purposes
- Engage in abusive or harmful behavior
- Fail to pay fees when due (for Premium subscribers)
We will provide notice before termination except in cases of severe violations requiring immediate action.
9.3 Effect of Termination
Upon termination:
- Your access to the Service will be immediately revoked
- Your location data will stop being shared with family members
- Your account data will be deleted according to our Privacy Policy
- Any outstanding payment obligations remain due
- All licenses granted to you will terminate
10. Disclaimers and Limitations of Liability
10.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, timely, secure, or error-free
- Warranties that location data will be 100% accurate at all times
- Warranties that the app will work on all devices or in all locations
- Warranties that the Service will meet your specific requirements
Location accuracy may vary based on device, network conditions, GPS signal, and other factors. Zamily should not be relied upon as the sole means of ensuring safety or locating individuals.
10.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, XELORA PTY LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury, property damage, or wrongful death
- Loss of profits, data, use, goodwill, or other intangible losses
- Failure to receive emergency alerts or locate individuals
- Unauthorized access to your account or data
- Any errors, mistakes, or inaccuracies in location data
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
10.3 Emergency Use Disclaimer
Zamily is not an emergency service. In case of emergency, always contact local emergency services (000 in Australia, 911 in the US) first. The SOS feature is designed to alert family members quickly but does not replace professional emergency response.
10.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition implied or imposed by the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law, to the extent that such guarantee, warranty, term, or condition cannot be excluded, restricted, or modified.
If you are a consumer under the Australian Consumer Law, you are entitled to the following statutory guarantees:
- Services will be rendered with due care and skill
- Services will be reasonably fit for any specified purpose
- Services will be supplied within a reasonable time
If we fail to meet any of these guarantees, you may have rights to remedies including repair, replacement, or refund. For more information about your rights under the Australian Consumer Law, visit www.accc.gov.au.
11. Indemnification
You agree to defend, indemnify, and hold harmless Xelora PTY LTD, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising from or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your misuse of location tracking features
12. Dispute Resolution
12.1 Informal Resolution
Before filing a formal legal claim, you agree to contact us at Email Legal and attempt to resolve the dispute informally. We'll make good faith efforts to resolve disputes within 30 days.
12.2 Arbitration Agreement
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis. You waive any right to participate in class actions or class-wide arbitration.
Arbitration will be conducted by the American Arbitration Association (AAA) in accordance with their Consumer Arbitration Rules.
12.3 Exceptions to Arbitration
Either party may bring an individual action in small claims court. Either party may seek injunctive or other equitable relief for intellectual property violations.
13. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the courts of New South Wales, Australia. Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other applicable consumer protection laws.
14. Changes to These Terms
We may modify these Terms at any time. We will notify you of significant changes:
- Through the app notification system
- By email (for material changes)
- By updating the "Last updated" date at the top of this page
Your continued use of Zamily after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Zamily regarding the Service.
